Our work typcially involves being an advocate for our clients, to resolve disputes in the most efficient and beneficial manner for our client. We focus and provide specialized services often not provided by other consultants, and with full time focus, the experience cannot be exceeded. Following are typical projects The Romstad Group is involved:
Contaminated Property Transaction
Defense or Affirmative Claim
These projects generally begin as a property transaction and a Phase I or field work during development (i.e. underground parking) has determined the property is contaminated from historical use. We support our clients by ensuring they only pay for what they may be responsible through a variety of methods, or if others impacted a property, we work to show responsibility and collect from others, to benefit out clients.
Evaluating and Allocating Responsibility
Former Agricultural Chemical Distribution Property
Often times The Romstad Group Inc. gets involved with two or more parties have impacted a property and various liablities need to be allocated.. As an example, we were retained by law firm representing an energy company where California DTSC was requiring the client to perform active assessment and remediation on a property with multiple potential Responsible Parties. We were able to break out our clients former agricultural chemical impact versus other parties, develop cleanup option and cost, and assist the law firm in obtaining a buy-out agreement for our client with DTSC, to be removed from future responsiblities and dispute.
Determine and Allocate Responsibility
Underground Pipelines, Terminals, and Refineries
The Romstad Group, Inc. has been retained on multiple occasions to evaluate the source and responsible party for petroleum impacts associated with releases from either underground pipelines, terminals, or refineries where multiple parties either have a potential nearby source or were the operator at one time. This often includes the use of both fate and transport and environmental forensics to come to a conclusion
Environmental Management - Third Party Releases
The Romstad Group Inc. provides Environmental Management of 3rd party consultants on behalf of responsible parties not leading execution. This includes reviewing draft Work Plans, correspondence, and reports. This also includes evaluating site conditions for potential new releases, and developing positions and associated costs to support claims against others.
